Supporters argue that AI-assisted sentencing eliminates the biases and emotional judgments of human judges, achieving consistent and fair sentencing while reducing court backlogs and judicial costs. Critics, however, warn that AI models can reproduce racial and socioeconomic biases embedded in historical sentencing data, that the opacity of algorithms undermines defendants' rights to due process and appeal, and that such systems fail to capture the nuances of human mitigating circumstances.
